Buffalo Man Admits to Stealing From a Trust That Was Set Up to Help Pay For Cancer Treatments for Woman

ERIE COUNTY DISTRICT ATTORNEY FRANK A. SEDITA, III ANNOUNCED that 36 YEAR OLD SCOTT HUBER OF 491 DELAWARE AVENUE, BUFFALO, PLEADED GUILTY THIS MORNING BEFORE COUNTY COURT JUDGE MICHAEL D’AMICO TO GRAND LARCENY IN THE SECOND DEGREE, AS CHARGED. THIS IS THE HIGHEST CHARGE FOR WHICH HUBER COULD HAVE BEEN CONVICTED HAD HE GONE TO TRIAL. 

HUBER ADMITTED THAT BETWEEN APRIL 19, 2010 AND JANUARY 12, 2011, HE STOLE MORE THAN $50,000.00 FROM THE MARY TOMASELLI (THE FORMER OWNER OF LA TEE DA RESTAURANT) BENEFIT IRREVOCABLE TRUST, WHICH WAS TO HELP PAY FOR HER CANCER TREAMENTs.

SENTENCING IS SCHEDULED FOR JUNE 26, 2012 AT 9:30 A.M. BEFORE THE HON. MICHAEL D’AMICO WHEN HUBER FACES A MAXIMUM PRISON SENTENCE OF 5 TO 15 YEARS.
