Jury Convicts Buffalo Man of Gun Charge

Acting Erie County District Attorney Michael J. Flaherty, Jr. announces that 34 year-old Johnnie Small of 90 Domedion Street in the City of Buffalo was found guilty of the charge of Criminal Possession of a Weapon in the 2nd Degree after a jury trial before County Court Judge Kenneth Case.  This was the highest charge for which the defendant could have been convicted. In other words, Small was prosecuted to the fullest extent of the law.

On September 28, 2014, Buffalo Police observed Small gambling in front of 88 Domedion Avenue.  When they pulled over to cite him for the gambling violation, he threw a gun to the ground and tried to run away.  The officers apprehended him immediately.

“Buffalo Police Officers Anthony Fanara and Mark Hamilton deserve all the credit for this arrest.  Their aggressive police work and good instincts allowed us to take another violent criminal off the streets” stated Acting District Attorney Michael J. Flaherty.      

Small faces a maximum prison term of 15 years when he is sentenced by Judge Case on March 16, 2016, at 9:30 a.m.  The case was successfully prosecuted by Assistant District Attorney John P. Gerken, Jr., who is assigned to Acting DA Flaherty’s Special Investigations and Prosecutions Unit.
