Buffalo Man Accused of Shooting Witness to Prevent Testimony in Homicide Trial

Erie County District Attorney John J. Flynn announces that 28-year-old Dayquain Trent, also known as “Brazzy,” of Buffalo has been arraigned before State Supreme Court Justice Paul B. Wojtaszek on an indictment charging him with one count of Attempted Murder in the Second Degree, a Class “B” felony, one count of Assault in the Second Degree, a Class “D” felony, one count of Tampering with a Witness in the Second Degree, a Class “D” felony, and one count of Criminal Possession of a Weapon in the Second Degree, a Class “C” felony.

It is alleged that on October 22, 2019, at approximately 6:00 a.m., the defendant shot the victim at a location on the East Side of the City of Buffalo. It is further alleged that the defendant intentionally shot the victim for the purpose of preventing the victim from providing testimony in the homicide trial against Lemuele Jackson. The victim was taken to ECMC to be treated for an injury to the left forearm.

Buffalo Police executed a search warrant on November 5, 2019 at a home on Edison Avenue where they allegedly recovered a loaded, operable pistol from the defendant’s bedroom.

Trent is scheduled to return on Wednesday, December 11, 2019 at 2 p.m. for a pre-trial conference. Judge Wojtaszek remanded the defendant without bail.

If convicted on all charges, he faces a maximum of 25 years in prison.

DA Flynn commends Detectives Anthony Fanara, Adam Wigdorski, Christopher Schaefer, and Nicole Krug of the Buffalo Police Department for their work in the investigation.

The case is being prosecuted by Assistant District Attorney John P. Gerken, Jr. of the DA’s Tactical Prosecution Unit.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
