Erie County District Attorney John J. Flynn announces that 25-year-old Allyson Rollek of the Town of Collins has been arraigned before Town of Concord Justice Timothy P. Frank on one count of Vehicular Manslaughter in the Second Degree.

It is alleged that on September 29, 2018, at approximately 2:18 p.m., Rollek was driving westbound on Creek Road in the Town of Concord, when she crossed over the double yellow lines and into the eastbound lane striking another vehicle head on.  The collision fatally injured Ralph Spaulding, 66, and injured his 11 year-old passenger.

Deputies at the scene felt her manner of speech and demeanor was consistent with narcotic use.  Testing of the defendant’s blood detected the presence of fentanyl.

Rollek was released on her own recognizance after her license was revoked.

If convicted, Rollek faces up to 7 years in prison

ADA Christopher M. McCarthy of the DA’s Vehicular Crimes Bureau is prosecuting the case.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
