Defendant Pending Prosecution for Killing Robbery Victim Indicted for Murdering Teen on Christmas Eve

Erie County District Attorney John J. Flynn announces that 19-year-old Calvin D. Clemons of Buffalo was arraigned this morning before Erie County Court Judge Susan Eagan on an indictment charging him with one count of Murder in the Second Degree (Class “A-I” felony) and one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony).

It is alleged that on December 24, 2020, at approximately 4:30 a.m., the defendant intentionally shot the victim with an illegal weapon. The victim, 17-year-old Felix Aguirre of Buffalo, was sitting inside of a parked vehicle on Liddell Street in the City of Buffalo when he was fatally injured. He died at the scene.

Clemons is scheduled to return on Friday, March 4, 2022 at 9:30 a.m. for motions. He was held without bail.

If convicted of all charges, Clemons faces a maximum of 25 years to life in prison.

Clemons is also pending prosecution for his alleged role in another homicide. Clemons and an adolescent offender are accused of killing 20-year-old Trenten Jacob Sink of Lockport during a robbery on C Street in the City of Buffalo on March 29, 2021. Clemons and the adolescent offender are scheduled to return on Monday, March 14, 2022 at 11:00 a.m. for motions. Both remain held without bail.

“All homicides are tragic, but this case is particularly heartbreaking. A teenage boy was murdered on Christmas Eve as his family was mourning the loss of his brother who was also killed in shooting a few months prior. I am committed to obtaining justice for this family by prosecuting this defendant for his crime while continuing to seek the person responsible for the murder of the victim’s brother Luis Rivera. I encourage anyone with information that may help us solved this case to come forward,” said Erie County District Attorney John J. Flynn.

The Erie County District Attorney’s Office and the Buffalo Police Department continue to investigate the murder of 24-year-old Luis Rivera who was fatally shot on Kenmore Avenue between Military Road and Melrose Avenue on September 14, 2020. DA Flynn commends Detectives Scott Malec and Mark White of the Buffalo Police Department Homicide Squad for their work in this investigation.

The case is being prosecuted by Chief Gary W. Hackbush of the Homicide Unit.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
