Erie County District Attorney John J. Flynn announces that 49-year-old Jermaine E. Turner was sentenced this morning before Erie County Court Judge Suzanne Maxwell Barnes to a determinate sentence of 12 years in prison followed by 5 years of post-release supervision. He was sentenced today as a second violent felony offender.

On Wednesday, April 6, 2022, members of the Erie County Sheriff’s Office Narcotics/Intelligence Unit executed warrants to search the defendant and his two known residences.

At approximately 12:39 p.m., deputies initiated a traffic stop on Route 33 in the Town of Cheektowaga to search the defendant. A quantity of crack cocaine, packaged for sale, was found inside of the defendant’s shirt pocket.

At approximately 2:32 p.m., a search warrant was executed at the defendant’s residence on Deborah Lane in the Town of Cheektowaga. Investigators found an assault rifle and approximately four ounces of cocaine inside of the home.

At approximately 3:53 p.m., investigators found an additional four ounces of cocaine and two illegal handguns inside of the defendant’s other known residence on Elm Street in the City of Buffalo.

The suspected narcotics were submitted to the Erie County Central Police Services laboratory, which positively identified the recovered substances as cocaine.

Turner pleaded guilty to one count of Criminal Possession of a Controlled Substance in the Second Degree (Class “A-II” felony), one count of Criminal Possession of a Controlled Substance in the Third Degree (Class “B” felony) and one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony). The defendant pleaded guilty to the highest sustainable charges on May 31, 2022.
