Erie County District Attorney John J. Flynn announces that 26-year-old Kalah Schultz of Brant has been sentenced by State Supreme Court Justice Paul B. Wojtaszek to 6 months in jail followed by 5 years of probation.

On December 10, 2018, at approximately 8:06 p.m., the defendant was driving on Route 438 on the Seneca Nation of Indians territory in the Town of Collins when her vehicle collided with another. All five people from the other vehicle were taken by ambulance to ECMC to be evaluated, and three suffered injuries as a result of the crash.

It was determined that Schultz was driving under the influence of alcohol with a BAC of 0.11%.

Schultz pleaded guilty to one count of Vehicular Assault in the First Degree, a Class “D” felony. She pleaded guilty to the highest sustainable charge on Tuesday, July 23, 2019.

DA Flynn commends the Erie County Sheriff’s Office Accident Investigation Unit for their work in the investigation.

The case was prosecuted by Assistant District Attorney Christopher M. McCarthy of the Vehicular Crimes Bureau.
