East Aurora Woman Charged with Vehicular Assault, DWI for Crash That Injured Child

Erie County District Attorney John J. Flynn announces that 30-year-old Erin Kuntz of East Aurora has been arraigned before Town of Aurora Justice Jeffrey Markello on one count of Vehicular Assault in the Second Degree, a Class “E” felony, one count of DWI, a misdemeanor, Unlawful Possession of Marijuana, a violation, and two vehicle and traffic law violations for a lane violation and refusal of a breath test.

It is alleged that on Sunday, July 21, 2019, at approximately 6:30 p.m., the defendant was driving a vehicle under the influence of alcohol on East Main Street in the Village of East Aurora when she attempted to drive around a parked vehicle then struck a 9-year-old female who was on the sidewalk.  

The child was taken by ambulance to Oishei Children’s Hospital to be treated for serious physical injuries.

Kuntz is scheduled to return on Tuesday, July 23 at 2:00 p.m. She was released on her own recognizance.

If convicted on all charges, Kuntz faces a maximum of 4 years in prison.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
