East Aurora Woman Receives Probation for Drunk Driving Crash That Injured A Child

Erie County District Attorney John J. Flynn announces that 30-year-old Erin Kuntz of East Aurora has been sentenced by Erie County Court Judge Susan Eagan to 5 years of probation.

On Sunday, July 21, 2019, at approximately 6:30 p.m., the defendant was driving a vehicle while under the influence of alcohol on East Main Street in the Village of East Aurora when she attempted to drive around a parked vehicle then struck a 9-year-old female who was on the sidewalk. The defendant was found to have a .20% BAC at the time of the crash.

The child was taken by ambulance to Oishei Children’s Hospital of Buffalo to be treated for serious physical injuries. The victim has since recovered.

Kuntz pleaded guilty, as charged, to one count of Vehicular Assault in the First Degree, a Class “D” felony, on December 16, 2019. She pleaded guilty to the highest sustainable charge.

In addition to her sentence, Judge Eagan suspended the defendant’s driver’s license for six months. Once she is able to obtain a license, Kuntz must install an ignition interlock device on her vehicle for the remainder of her probationary period.

DA Flynn commends Lt. Dustin Waldron from the East Aurora Police Department for his work in the investigation.

The case was prosecuted by Chief Paul Glascott of the DA’s Vehicular Crimes Bureau.
