Erie County District Attorney John J. Flynn announces that 21-year-old Brian Lee of Buffalo has pleaded guilty before State Supreme Court Justice Christopher J. Burns to two counts of Vehicular Assault in the Second Degree. 

On June 24, 2016 at approximately 2:00 a.m., while in an intoxicated condition, Brian Lee was speeding on Ogden Street in the vicinity of Broadway when he lost control of his car, went onto the railroad tracks and crashed.  

The collision caused serious physical injury to two of his passengers.  21-year-old Ashley Kollander of Cheektowaga and 21-year-old Traiya Skeels of Sloan both sustained fractures to their spines as a result of the collision.  The defendant's BAC was .16%, twice the legal limit. 

Lee faces up to four years in prison when he is sentenced by Justice Burns on April 27, 2017 at 9:30 a.m. 

DA Flynn credits the Buffalo Police Accident Investigation Unit, including Lt. Thomas Leatherbarrow. 

Chief Kelley A. Omel of the DA’s Vehicular Crimes Bureau is prosecuting the case.
