Gunman Sentenced for Injuring Two People in Shooting Outside Pearl Street Restaurant

Erie County District Attorney John J. Flynn announces that 24-year-old Kyle M. Mickens of Buffalo was sentenced this morning before Erie County Court Judge Kenneth Case to 9 years in prison followed by 5 years of post-release supervision.

On Saturday, May 21, 2022, at approximately 2:04 a.m., the defendant, with the intent to cause the death of another person, fired multiple shots from an illegal gun into a moving vehicle on the 400 block of Pearl Street in the City of Buffalo. Investigators recovered numerous fired cartridge casings from the scene.

One person inside of the vehicle was injured by gunfire. The victim, a 25-year-old woman who was in the front passenger seat, was treated at ECMC for serious physical injuries to her leg.

Another victim, a 23-year-old man who was on the opposite side of the street, was also injured by gunfire. He was taken by ambulance to ECMC to be treated for a gunshot wound to his hip.

Mickens pleaded guilty to one count of Attempted Murder in the Second Degree, two counts of Assault in the First Degree (Class “B” violent felonies) and one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony). The defendant pleaded guilty to all counts in the indictment against him on September 12, 2022.

The case against his co-defendant, 24-year-old Dalton O. Edge, Jr., of Buffalo, remains pending. Edge is scheduled to return on Monday, November 21, 2022 at 2:00 p.m. for a pre-trial hearing. He also remains held without bail.

DA Flynn commends the Buffalo Police Department Intelligence Unit and Special Operations Unit as well as the Gun Violence Unit for their work in this investigation.

The case is being prosecuted by Assistant District Attorney Rebecca L. Schnirel of the Major Crimes Unit.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
