Inmate Indicted for Assaulting His Defense Attorney Inside Erie County Correctional Facility

Erie County District Attorney John J. Flynn announces that 38-year-old Londarr S. Ward of Buffalo was arraigned this morning before State Supreme Court Justice M. William Boller on an indictment charging him with one count of Assault in the Second Degree (Class “D” felony).

It is alleged that on Tuesday, September 27, 2022, at approximately 10:03 a.m., the defendant assaulted his defense attorney during a meeting inside of the Erie County Correctional Facility on Walden Avenue in the Town of Alden. The defendant allegedly punched the victim multiple times with a closed fist. The victim suffered injuries to his face, left shoulder and chest.

If convicted of the charge, Ward faces a maximum sentence of 7 years in prison.

The alleged crime occurred while the defendant was in custody at the Erie County Correctional Facility on a pending separate criminal matter. Ward was indicted on four counts of Robbery in the First Degree (Class “B” violent felonies) and one count of Criminal Possession of Stolen Property in the Fifth Degree (Class “A” misdemeanor). He was arraigned before Erie County Court Judge James Bargnesi on June 10, 2021.

It is alleged that on February 22, 2021, at approximately 7:38 p.m., the defendant displayed what appeared to be a pistol and forcibly stole cash from the register and scratch-off lottery tickets from the Sunoco store on Union Road in the Town of Cheektowaga.

It is alleged that on February 24, 2021, at approximately 8:39 p.m., the defendant displayed what appeared to be a pistol and forcibly stole cash from the register and scratch-off lottery tickets from the Kwik Fill store on Harlem Road in the Town of Cheektowaga.

It is alleged that on February 28, 2021, at approximately 8:23 p.m., the defendant displayed what appeared to be pistol and forcibly stole cash from the register and scratch-off lottery tickets from the Kwik Fill store on Millersport Highway in the Town of Amherst.

It is alleged that on March 7, 2021, at approximately 7:43 p.m., the defendant displayed what appeared to be a pistol and forcibly stole cash from the register and scratch-off lottery tickets from the Marathon gas station store on Grover Cleveland Highway in the Town of Amherst.

It is alleged that on March 8, 2021, the defendant was found in possession of lottery tickets reported stolen from the Marathon gas station store on Grover Cleveland Highway while being placed under arrest.

Ward was initially arraigned for the two alleged robberies in the Town of Cheektowaga on March 9, 2021. He was held on $75,000 cash, bond, or partially secured bond. He was arraigned the following day in Amherst Town Court and held without bail.  

If convicted of one count of Robbery in the First Degree, the highest charge in this indictment, Ward faces a maximum sentence of 25 years in prison.  If convicted of two or more counts of Robbery in the First Degree, Ward faces a maximum sentence of 50 years in prison.   

Ward is scheduled to return on Wednesday, November 23, 2022, at 2:00 p.m. for a pre-trial conference on both cases. He continues to be held without bail.

DA Flynn commends the Erie County Sheriff’s Office for their work in this investigation as well as the various police agencies involved in his pending criminal case.

The assault case is being prosecuted by Assistant District Attorney Briana R. D. Miller of the Felony Trials Bureau. The robbery case is being prosecuted by Assistant District Attorney Hilarie L. Henry of the Special Victims/Domestic Violence Bureau and Assistant District Attorney Beth Solek of the Vehicular Crimes Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
