Judge Finds Clarence Man Guilty of Misdemeanor Assault Charge for Attacking His Elderly Step-Father

Erie County District Attorney John J. Flynn announces that Erie County Court Judge James Bargnesi has found 43-year-old Jonathan C. McKibben of Clarence guilty of one count of Assault in the Third Degree (Class “A” misdemeanor). Judge Bargnesi found the defendant guilty of the lesser included offense following a one-day bench trial that occurred on Monday, February 7, 2022. The defendant was acquitted of the felony assault and burglary charges.

On July 30, 2020, at approximately 10:29 a.m., the defendant attacked his elderly step-father inside of a home on Manor Wood Lane in the Town of Clarence. The defendant stabbed the victim multiple times with a knife. The victim was taken to ECMC where he was treated for non-life threatening injuries.

McKibben faces a maximum of one year in jail when he is sentenced on Tuesday, April 5, 2022 at 9:30 a.m. He continues to remain held on $100,000 bail.  

DA Flynn commends the Erie County Sheriff’s Office for their work in the investigation.

The case was prosecuted by Assistant District Attorney David M. Zak of the Felony Trials Bureau.
