Jury Finds Driver Guilty for Killing Pedestrian in Hit-and-Run on Broadway in Summer 2017

Erie County District Attorney John J. Flynn announces that a jury has found 36-year-old D’Mario A. Caesar of Buffalo guilty of one count of Manslaughter in the Second Degree (Class “C” felony) and one count of Leaving the Scene of an Incident Without Reporting Resulting in Death (Class “D” felony). Jurors rendered their decision this afternoon after about an hour of deliberation following a 6-day trial, convicting the defendant of all counts in the indictment against him.

On July 16, 2017, at approximately 3:08 a.m., the defendant was driving a SUV at a high-rate of speed on Broadway in the City of Buffalo when he hit a pedestrian who was crossing the street near Bailey Avenue. The defendant left the scene without reporting the incident to police. The victim, 31-year-old Brandyn Mallory of Buffalo, died later that morning at ECMC.

The defendant’s vehicle was found unoccupied on Broadway near Greene Street, a short distance away from the scene of the crime.

Caesar faces a maximum of 15 years in prison when he is sentenced before Erie County Court Judge Susan Eagan on Wednesday, March 29, 2023 at 2:00 p.m. He remains held without bail.

DA Flynn commends the Buffalo Police Department Accident Investigation Unit for their work in the investigation.  

The case was prosecuted by Chief Patrick B. Shanahan of the Felony Trials Bureau and Assistant District Attorney Gina M. Gramaglia of the Special Victims/Domestic Violence Bureau.
