Acting Erie County District Attorney Michael J. Flaherty, Jr. announces 19-year-old Dmitri Cunningham has pleaded guilty to two counts of Attempted Criminal Sexual Act in the First Degree before State Supreme Court Justice Penny Wolfgang.

Cunningham, who has been jailed since December 10, 2015, admitted to engaging in oral sexual conduct with a 12-year-old child.

Investigators say the defendant, who formerly lived at 9 Duerstein in Buffalo, frequented Cazenovia Park.

Cunningham faces a maximum of 15 years in prison when he is sentenced on May 16, 2016 at 9:30 a.m. by Justice Wolfgang.

This conviction also subjects the defendant to the Sex Offender Registration Act wherein he must register as a Sex Offender and abide by the monitoring requirements of the Act.

The defendant has a prior conviction for attempted assault arising from an incident in Cazenovia Park.

Acting DA Flaherty commends Detective Valerie Stover-Kelly of the Sex Offense Squad of the Buffalo Police Department for leading this investigation.

Assistant District Attorney Bethany A. Solek prosecuted the case.
