Acting Erie County District Attorney Michael J. Flaherty, Jr. announces that 39-year-old Kevin McCutcheon of South Buffalo has pleaded guilty to one count of Sexual Abuse in the First Degree before State Supreme Court Justice Penny Wolfgang.

The defendant admitted to forcing the victim to engage in sexual conduct with him on August 30-31, 2015 at a house on Walden Avenue. According to the victim, the defendant raped her and forced her to endure anal sexual conduct.

McCutcheon faces 3-7 years in prison when he is sentenced on July 13, 2016 at 9:30 a.m. by Justice Wolfgang. He will also be required to register as a sex offender.

Acting DA Flaherty commends the investigative work of Detectives Judy Walker and Melanie Neureuther of the Buffalo Police Department Sexual Offense Squad as well as Lt. Michelle Kubala of D district.

Assistant District Attorney Bethany A. Solek of Acting DA Flaherty’s Special Victims Bureau is prosecuting the case.
