Teen Indicted for Shooting Security Guard Who Intervened in Assault Outside of McKinley High School

Erie County District Attorney John J. Flynn announces that a 17-year-old male from Buffalo was arraigned this morning before Erie County Court Judge Kenneth Case, a designated Youth Part judge, on one count of Attempted Murder in the Second Degree (Class “B” violent felony), one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony), and one count of Assault in the Second Degree (Class “D” felony).

It is alleged that on Wednesday, February 9, 2022, at approximately 3:45 p.m., a co-defendant and other unknown individual(s), were involved in the assault of a student outside of McKinley High School in the City of Buffalo. The 14-year-old male student was beaten and stabbed during the altercation.

The adolescent offender is accused of intentionally firing multiple rounds from an illegal gun into the group of individuals. The adolescent offender’s alleged actions caused physical injury to a school security officer who ran toward the crowd in an attempt to break up the fight. The unarmed security guard, a 27-year-old male, was taken by ambulance to ECMC where he was treated and released for a gunshot wound to his left leg.

The 14-year-old victim was taken by ambulance to Oishei Children’s Hospital where he was hospitalized with serious physical injuries from multiple stab wounds.

The adolescent offender is scheduled to return on Wednesday, March 23, 2022 at 11:00 a.m. for a pre-trial conference. He continues to be remanded to the custody of the Erie County Youth Services Center. 

His co-defendant, another 17-year-old male from Buffalo, was arraigned on the indictment earlier this week for his alleged involvement in the assault and stabbing of the student. The adolescent offender is also scheduled to return on Wednesday, March 23, 2022 at 11:00 a.m. for a pre-trial conference.

DA Flynn commends the Buffalo Police Department all other assisting law enforcement agencies for their work in this ongoing investigation.

The case is being prosecuted by Chief John P. Feroleto of the Major Crimes Unit and Chief Danielle N. D’Abate of the Community Prosecution and Training Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
