Integrated Reviews & SEQR Submissions

NOTE: Only municipal representatives (such as municipal clerks, code enforcement officers, planners, attorneys, supervisors, engineers, etc.) may use this form. Developers, residents, and any other applicant/proponent and/or their representative MUST contact the municipality directly for guidance.

Please select the option that describes this submission's PRIMARY purpose (i.e., if it includes a site plan, but also a Lead Agency Request, please use SEQRA. If it is a Lead Agency Request because a site plan application is an Unlisted or Type I action, please use SEQRA. If it is only a site plan application as submitted to the municipality, please select GML 239 referral)
Review the referral map to ensure the action must be referred to Erie County through GML §239

Complete GML 239 (Integrated Review) referral includes at least:

- ZR1 form

- Project/Proposal description

- Site Plan (if applicable)

- SEAF or FEAF

- Application documents submitted to the municipality


Referrals may also include:

- Traffic Studies

- Wetlands Delineations

- Letters from SHPO, Army Corps of Engineers, DEC, etc.

- Other relevant studies and documents

GML 239 Report of Final Action (REQUIRED for all actions submitted to the County through GML 239)
Submit a copy of your municipality's letter and/or resolution regarding the decision ("Final Action"); for example: resolutions approving or denying site plans and/or variances
SEQRA submission:
This may include any one of the following: Lead Agency Request, a Coordinated Review, an Uncoordinated Review, Environmental Impact Statements, Impact Declarations, etc.

If there is no road/mailing address, you may use "Vacant Lot" (V/L) or similar term. If the action applies to the entire municipality (such as zoning code amendments or comprehensive plans), you may use "Entire Municipality" or similar term

Select only for COUNTY RIGHT OF WAY REVIEW.
Do NOT select for NYS right of way; those must be sent to NYS DOT. ECDPW will NOT review NYSDOT ROW.
Select only if project involves an existing or new sanitary or combined sewer connection (for example: existing, new, or increased bathrooms or kitchens; not fence or sign variances or other similar projects)
Project components requiring referral to ECDOH
land subdivision of five or more lots of under five acres each, for houses
New and renovations, public or private community pool (including apartment complexes, subdivisions, and hotels/motels). Does not include private household use (family and friends) pools.
Generally for new developments. Note: S Con minimum of 2500 gpd wastewater flowrate
Residential/commercial septic system flow <10,000 gpd, does not contain industrial wastes, and is not a full wastewater treatment plant. (All others must be referred to NYS DEC instead)
Has this project been referred to the Erie County Department of Health before and/or separately?
