Sheriff Tim Howard reports that a Town of Concord woman was arrested for D.W.I. late this afternoon. Cheryl R. Merlau, age 47, of Concord Rd. was arrested after becoming involved in a two vehicle accident causing minor injury to the other driver.
Merlau's vehicle was west bound on Genesee Rd. in the Town of Concord, when she attempted to make a left turn onto Kern Rd. in front of a vehicle heading east bound, causing the collision.
Deputy Ken Hetey, of the Erie County Sheriff's Colden Sub-Station responded to the scene, and observed that Merlau exibited signs of intoxication.She was administered several field sobriety tests, which were failed. Merlau volunteered to submit to a breath test, and did register a .20% B.A.C.(Blood Alcohol Content), which is 2 1/2 times the legal limit.
This prompted an additional charge of Aggravated D.W.I. (.18% or higher). In addition to D.W.I., Merlau was charged with an infraction for failing to yield the right of way to an oncoming vehicle, while attempting to make a left turn. She was released to a third party on traffic summonses, pending a future date in the Town of Concord Court. Deputy Hetey was assisted at the accident scene by Deputies Tom Was and Tim Ulinger.
The defendant's vehicle was towed from the scene and a 12 hour hold was placed on it.
This is the 256th arrest for Driving While Intoxicated made by the the Erie County Sheriff's Office in 2013.
