AGGRAVATED DWI ARREST IN MARILLA


Sheriff Tim Howard reports that a Town of Marilla man was arrested on various charges yesterday afternoon.  John E. Young, age 66 was arrested after becoming involved in a two vehicle property damage accident on Four Rod Road near Clintons Street whereby he left the scene. 

Deputy Tim Higgins was responding to the accident call when he spotted the defendants' vehicle passing him in the opposite direction.  The vehicle was finally stopped on Jamison Road near Creek Road in the Town of Elma.  The driver wasgiven several field sobriety tests, which he failed, prompting his arrest.

Mr. Young did volunteer to submit to a chemical test and did register a .26% BAC more than three times the legal limit for intoxication.  This prompted the additional charges of Aggravated DWI (.18%) or higer. 

In addition to the above, he was charged with making an improper turn and leaving the scene of a property damage accident.  Mr.  Young was released to a third party on traffic summonses pending a future date in the Town of Marilla.

His vehicle was towed and a12 hour hold was placed on it.

This is the 279th DWI made by the Erie County Sheriff's Office in 2013.
