Erie County Sheriff Timothy B. Howard reports the late evening arrest of a Town of Alden man for Aggravated DWI following a complaint of his reckless driving in the Town of Newstead.
Erie County Sheriff's Deputy Simon Biegasiewicz and State Police Troopers responded to Main Rd. in the Town of Newstead for a report of a reckless driver travelling eastbound about 11:15pm Saturday night. Deputy Biegasiewicz and State Police located the vehicle pulled over on the side of the road near Cummings Rd. and found the driver, 52 year old John P. Rogacki of North Millgrove Rd. in Alden, to be highly intoxicated.
Rogacki was arrested and charged with DWI. Rogacki submitted to a chemical breath test which resulted in a .30% BAC, almost four times over the legal limit, making it an aggravated DWI charge. Rogacki's vehicle was towed from the scene and he was later released to a third party on appearance tickets for the Town of Newstead Court at a later date.
This was the 115th DWI arrest by the Erie County Sheriff's Road Patrol this year.
