ALERT NEIGHBOR TIP LEADS TO BRUGLARY SUSPECT'S ARREST IN ELMA


March 17, 2012 - Town of Elma - Sheriff Tim Howard reports that a tip from an alert neighbor lead to the arrest of a Depew man on Felony Burglary Charges just before noon on Saturday.  Deputies Jason Weiss and Tom Was responded to the vacant residence within minutes of receiving the call and found Phillip M. Migdalski, age 30 of Bordern Road, in a bedroom hiding behind a bed.  He was taken into custody without incident.  During a search of the suspect, the deputies found a gold bracelet in one of his pockets, which had been taken from the  residence.  He apparently was able to gain entry to the home by an unlocked sliding door.  Migdalski was charged with Burglary in the third degree; petit larceny and criminal trespass in the third degree, both misdemeanors.  The suspect's vehicle, which had been parked in the parking lot of the Springbrook Firehall was towed from the scene.  Migdalski was transported to the Erie County Holding Center to be held pending arraignment in the Town of Elma Court.
