May 28, 2012- Erie County Sheriff Timothy B. Howard reports the arrest of four local subjects for a variety of charges stemming from two separate incidents at Bennett Beach in Evans.
During increased patrols in the area of Bennett Beach due to the large amount of people in the park, Deputy Chris Soluri arrested Sean P. Brogan (19) of West Seneca and charged him with DWI after failing sobriety testing during a road check set up at the park exit. A breath test revealed his blood alcohol content to be .10%. He was processed at the North Collins Substation and released on appearance tickets.
A short time later during the same road check, Deputy Soluri arrested Michael A. Giordano (31) of Buffalo, Kayla A. Fiel (19) of Grand Island, and Matthew L. Ortiz (22) of Buffalo and charged them all with Fifth Degree Marihuana Possession, Seventh Degree Narcotics Possession (cocaine) and Endangering the Welfare of a Child after the Deputies noticed a strong smell of Marihuana coming out of the vehicle. The subjects attempted to conceal the Marihuana in the clothes of a three year old female that was a passenger in the vehicle. All subjects were processed at the North Collins Substation. Fiel and Giordano were released on appearance tickets for Evans Court, and Ortiz was transported to the Holding Center and held for proper identification purposes. The child was turned over to her mother, and a Child Protection Services report was filed concerning the incident.
