BOATING WHILE INTOXICATED

JULY 4, 2012- City of Buffalo- Erie County Sheriff Timothy B. Howard reports the arrest of a Depew resident for Boating While Intoxicated by Sheriff’s Marine Patrols in the Niagara River on July 4th

While conducting a check of the Ontario Street Boat Launch at approximately 5:51 PM on Sheriff’s Marine Unit 2 (MU-2), Deputies Tom Meredith, Michael Okal and Tim Dusza noticed a boat operator having a very difficult time docking his boat, and then noticed him stumble and fall into the water.  After checking to make sure that the man was alright from his fall, the Deputies determined that he had been drinking heavily and conducted field sobriety testing.  After their investigation, they arrested the operator:  Delane V. Grimes (53) of Depew and charged him with Boating While Intoxicated and Navigation Law violations.  A breath test determined his blood alcohol content to be .16%, twice the legal limit.  He was processed at the Grand Island Substation and released on appearance tickets.

At approximately 9:42PM, while conducting a check of the Erie Basin Marina, the same Deputies conducted a vessel inspection of a boat operating without navigation lights.  A check of the operator:  Vladislav Kats (26) revealed that he was wanted on an outstanding warrant for vehicle and traffic charges by Buffalo Police.  He was subsequently arrested for multiple navigation law violations and turned over to Buffalo Police for the warrant.
