June 9, 2013- Erie County Sheriff Tim Howard is reorting the arrest of a City of Buffalo man for Boating While Intoxicated.
Deputies Okal & Kent of the Erie County Sheriff's Marine Unit observed a personal watercraft after sunset at the Gallagher Beach Area and at a speed greater than 5 mph w/in 100' of the shore. Patrol stopped the vessel and upon interviewing the operator, 32 yr. old Ian Piercy, patrol detected a strong odor of an alcoholic beverage. The operator, Mr. Piercy, was placed under arrest for Boating While Intoxicated after failing all the standardized field sobriety tests. Mr. Piercy refused to submit to a chemical breath test.
Mr. Piercy was then charged with Boating While Intoxicated - Commonlaw, Failing to Submit to a Breath Test, Operating a Personal Watercraft after Sunset and Operating at a Speed Greater than 5 mph w/in 100' of Shore.
Mr. Piercy was released to a third party on uniform traffic tickets.
