Sheriff Tim Howard reports that while on patrol in the early morning hours of April 18, 2013 Deputy Matt Krypel stopped a vehicle on Southwestern Blvd on the Cattaraugus Indian Reservation. The vehicle was stopped for speeding and driving on the shoulder of the road. During the course of the traffic stop the operator of the vehicle, Kelly C. Mallaber, age 21, of Gowanda failed field sobriety tests and was arrested for Driving While Intoxicated. She was taken to the Sheriffs substation in North Collins where she submitted to a breath test. The test result was .20% BAC which is more than twice the legal limit. As a result of the test she was also charged with Aggravated DWI. A check of Mallaber's driver's license revealed that it was suspended for failure to answer a summons. This added a charge of Aggravated Unlicensed Operation in the 3rd degree She was also charged with speeding, driving on the shoulder of the road, open alcohol container in a vehicle and obstructed view. Her vehicle was towed from the scene of the arrest and a 12 hour hold was placed on it. Mallaber was released on traffic tickets to the custody of her mother. She is to appear next week in the Town of Brant court to answer to the charges.
