Erie County Sheriff Tim Howard is announcing the arrest of a Town of Marilla man for driving while intoxicated. This is the Erie County Sheriff's Office 148th DWI arrest in 2013.

Deputy George Avery responded to a report of a single motor vehicle accident on Clinton St. in the Town of Marilla. The officer found the driver, 22 yr. old, Zachary Wyzykowski, to be intoxicated. Mr. Wyzykowski was taken into custody and transported to the Erie County Sheriff's Elma Substation where he was administered a chemical breath test. Mr. Wyzykowski's blood alcohol content was a .11%. Mr. Wyzykowski was charged with driving while intoxicated and several other vehicle and traffic violations.

He was released to a third party on uniform traffic tickets returnable to the Town of Marilla Court at a future date.
