July 6, 2013- Erie County Sheriff Tim Howard reports that the Erie County Sheriff's Office made two DWI arrests overnight. These two arrests are the 165th and 166th DWI arrests for the Erie County Sheriff's Office in 2013.
In the first incident, Deputies Daniel Harris and Richard Retzlaff observed a subject, 38 yr. old Kenneth Maksymik of the Town of Hamburg, outside his vehicle which was stopped on the side of the road. When patrol stopped to check out the situation, Mr. Maksymik had re-entered his vehicle which was running. Upon further investigation, Mr. Maksymik was found to be intoxicated and was taken into custody. Mr. Maksymik was transported to the Erie County Sheriff's Clarence Substation and a chemical breath test was administered to Mr. Maksymik. This test showed his blood alcohol content to be .12%. Mr. Maksymik was charged w/ DWI and numerous other vehicle and traffic charges. Mr. Maksymik was released to a third party on uniform traffic tickets returnable to the Town of Lancaster Court at a later date.
In the second incident, Deputy George Avery observed a vehicle speeding on Big Tree Rd. in the Town of Wales. Deputy Avery conducted a traffic stop and found that the vehicle was operated by 40 yr. old Colin Reich of East Aurora. Upon further investigation, Mr. Reich was found to be intoxicated. Mr. Reich was taken into custody and transported to the Erie County Sheriff's Elma Substation. Mr. Reich was administered a chemical breath test and the blood alcohol content was found to be .18%. Mr. Reich was charged w/ DWI and other vehicle and traffic charges and then released to a third party on uniform traffic tickets returnable to the Town of Wales Court at a later date.
