FELONY DWI AND FELONY AGGRAVATED UNLICENSED OPERATION

January 17, 2013- Erie County Sheriff Timothy B. Howard reports the arrest of an area driver for Felony Aggravated Unlicensed Operation and Felony Driving While Intoxicated by Sheriff’s Road Patrols on Thursday night.

While on patrol in the Village of Akron at about 9:00pm Deputy Lee Richard initiated a traffic stop that led to the arrest of Steven E. Wells of Oakfield.  Wells, whose license is suspended for pervious alcohol related driving arrests was driving while under the influence of alcohol and as a result he was charged with Aggravated Unlicensed Operation of a Vehicle in the 1st degree, which is a felony.  His Blood Alcohol Content was .20%, two and a half times the legal limit.  He was charged with aggravated DWI because his BAC was over .18% and this DWI is also a felony due to Mr. Wells having previously been convicted for DWI.  He was also operating a vehicle without an interlock ignition device as was order for his previous DWI arrest.  This resulted in a misdemeanor charge for operating a vehicle without the interlock device.  He was released on tickets to appear in Akron Village court at a future date.
