FELONY DWI AND LEANDRA'S LAW ARRESTS


December 5, 2011- Sheriff Timothy B. Howard reports the arrest of a Town of Basom man and his wife for DWI and for Leandra's Law violations. 

Deputy Timoth Cannan responded to a two car property damage accident on Transit Road in the Town of Clarence.  Upon arrival, Deputy Cannan was informed by witnesses that the driver in one of the vehicle's had switched places with the passenger.  Further investigation found that 42 year old Leiland B. Jonathan of Basom had switched places with is wife, Larue F. Jonathan, to avoid being charged with DWI.

Leiland admitted to Deputy Cannan that he was in fact the driver of the vehicle when it had been involved in the accident.  Leiland was arrested for DWI and three counts of violating Leandra's law for driving while intoxicated with his three children in the vehicle.  He refused to submit to a breath test.  Leiland's DWI charge was upgraded to a felony due to a previous DWI conviction in 2003.

Larue F.  Jonathan was also charged with DWI and three counts of violating Leandra's Law as she was also found to be intoxicated when she switched places with her husband as the driver of the vehicle.  Larue was additionally charged with Obstructing Governmental Administration and Resisting arrest.  Larue also refused to submit to a breath test.  Both of the Jonathans were transported to the Erie County Holding Center pending arraignment in the Town of Clarence Court.
