FELONY DWI ARREST


February 3, 2013- Town of Boston- Sheriff Tim Howard reports the arrest of a Town of Hamburg man for Felony Driving While Intoxicated.   This is the 37th DWI arrest made by the ECSO in 2013.

Erie County Sheriff's Deputy Brad Ballantyne located a vehicle operated by 38 year old Frank Richards, after receiving a report that Mr. Richards was involved in a disturbance on Feddick Road in the Town of Boston and left the scene before patrol arrived at same.  It was also reported to the ECSO that Mr. Richards had been drinking. Upon further investigation, Deputy Ballantyne found Mr. Richards to be intoxicated and placed him in custody.  Mr. Richards was taken to the Erie County Sheriff's North Collins substation and a chemical breath test was administered.  The test revealed that Mr. Richards had a blood alcohol content of .11%.  Due to Mr. Richards having a prior conviction from 2007, Mr. Richards was charged with Felony DWI.  Mr. Richards was also charged with unlawful possession of marijuana.  Mr. Richards was taken to the Erie County Holding Center pending arraignment in the Town of Boston Court at a later date.
