June 14, 2013- Erie Co. Sheriff Timothy B. Howard reports the arrest of a City of Lockport man for Felony Driving While Intoxicated. This is the 154th DWI arrest made by the Erie County Sheriff’s in 2013.
Erie Co Sheriff’s Deputy Jason Breinlinger responded to an unrelated complaint at the Seneca One Stop. While handling this unrelated complaint, Deputy Breinlinger observed a vehicle matching the description from a prior complaint which involved a possible intoxicated driver.
The operator of this vehicle, 28 yr. old Cody Pembleton, was found to be intoxicated and was taken into custody. Mr. Pembleton refused to submit to any standardized field sobriety tests and he refused to submit to a chemical breath test. After being arrested for Felony DWI and Felony Aggravated Unlicensed Operation, Mr. Pembleton was taken to the Erie County Holding Center pending arraignment. The DWI was a felony due to a prior conviction of DWI in July of 2009. Mr. Pembleton will be arraigned at a future date in the Town of Brant Court.
