May 2, 2012- Town of Boston- Erie County Sheriff Timothy B. Howard reports the arrest of a Hamburg resident for Felony DWI in violation of Leandra’s Law and multiple other charges after a traffic stop in Boston by Sheriff’s Road Patrols on Wednesday evening.
While on patrol in Boston, Deputy Theresa Nietzel stopped a vehicle driven by Gregory Durrett (41) of Hamburg for failure to use a turn signal on Creekside Court. The Deputy noted while speaking with Durrett that he appeared to be intoxicated by alcohol. She also discovered that there were open alcoholic beverages in the vehicle and that there was a fifteen year old female in the back seat who was not wearing a seatbelt and had also consumed alcohol. After her investigation, Deputy Nietzel arrested Durrett and charged him with Felony Aggravated DWI (Leandra’s Law – driving drunk with a person 15 years or younger in the vehicle), Felony DWI (prior conviction for DWI in 2008), Endangering the Welfare of a Child, Marihuana Possession and multiple traffic infractions. A breath test revealed his blood alcohol content to be .20%, over twice the legal limit. He was processed and arraigned in Boston Town Court. After arraignment, he was transported to the Holding Center on $250 bail set by the Boston Town Justice.
Two other occupants of the vehicle were also arrested and charged with Endangering the Welfare of a Child for their part in serving alcohol to the fifteen year old girl. Joseph D. Wahler (30) of Orchard Park (also charged with Marihuana Possession) and an eighteen year old male who will not be named due to his age were released on appearance tickets.
