September 21, 2012- Erie County Sheriff Timothy B. Howard reports the morning arrest of a Buffalo man for Felony DWI and Leaving the Scene of a Property Damage Accident in the Town of Wales.
Erie County Sheriff’s Deputies David Makowski and Anthony Yavicoli responded to Big Tree Rd. in the Town of Wales for a reported two car property damage accident where one of the vehicles had left the scene. The vehicle which left was found a short time later, unoccupied, parked off the road on Rt. 78 in Wales and the driver, 59 y/o Robert J. Peckey of Buffalo, was located by patrol also a short time later, walking on Rt. 78 in Wales.
Upon further investigation and field sobriety tests, it was discovered that Peckey was intoxicated, and had a chemical test reading of .16% BAC, double the legal limit. Peckey had a prior DWI conviction within the last 10 years, making this a Felony DWI charge.
Peckey was charged with Felony DWI, Leaving the Scene of a Property Damage Accident, and a couple other vehicle and traffic infractions.
Peckey was arraigned in the Town of Elma Court and given a $10,000 bail, which was later posted, and Peckey was subsequently released with a future court date.
There were no injuries from the accident.
