March 8, 2012- Town of Elma- Sheriff Tim Howard reports that a month long investigation of multiple larcenies in the Town of Elma has resulted in the arrest of two individuals. The investigation was conducted by Deputies Jason Weiss, Tom Was and Tim Higgins of the Elma substation.
A vacant residence located on Jamison Road had been the target of 51 year old Paul Phillians and his 47 year old brother Gary Phillians, Jr. both of Elma. These two individuals went to the vacant address on several dates to remove aluminum siding from the house and sell it for scrap. They also took a horse trailer, farm tractor and van from the property. The horse trailer and aluminum siding were sold to Twin Village Recycling for scrap. The tractor and van were sold to another individual who was not aware that the items were stolen. With information obtained by the deputies and Trooper Barry of NYSP, the individual who purchased these items was located. The horse trailer and tractor were recovered but the van had already been sold for scrap. Throughout the investigation the deputies were in contact with the property owners and they were kept apprised of the investigation.
Both Phillians were charged with Trespass; Petit Larceny and Criminal Possession of Stolen Property- 5th degree. Paul Phillians was also charged with Grand Larceny 4th degree. They were arrested on these charges and are awaiting further proceedings in the Town of Elma Court.
