June 7, 2013- Erie County Sheriff Tim Howard is announcing that the Erie County Sheriff's Office made two DWI arrests overnight. These two arrests are the 149th and 150th DWI arrests for the Erie County Sheriff's Office in 2013.
In the first incident, Deputy Matthew Krypel stopped a vehicle operated by a Village of East Aurora man when he observed the vehicle speeding, unable to stay in its lane and failing to obey a no passing zone on East River Rd. in the Town of Grand Island. Upon conducting the traffic stop, the 29 yr. old driver, Max Nelson, was found to be intoxicated. Mr. Nelson was taken into custody and transported to the Erie County Sheriff's Grand Island Substation. A chemical breath test was administered to Mr. Nelson and this test showed his blood alcohol content to be .17%. Mr. Nelson was previously convicted of a DWI March of 2007, therefore he is charged w/ Felony DWI and numerous other vehicle and traffic charges. Mr. Nelson was taken to the Erie COunty Holding Center pending arraignment in the Town of Grand Island Court at a later date.
Deputy Timothy Colling assisted by Deputy George Avery responded to a report of a vehicle being operated recklessly. The vehicle was located on Clinton St. in the Town of Elma. The driver, 27 yr. old Nicole Bates of Elma, was found to be intoxicated. Ms. Bates was taken into custody and transported to the Erie County Sheriff's Elma Substation. Ms. Bates refused to submit to a chemical breath test. Ms. Bates was charged w/ DWI and other vehicle and traffic charges and then taken to the Erie County Holding Center pending arraignment in the Town of Elma Court at a later date.
