1 Aggravated DWI following a Crash and Another Impaired Driver with Drugs 

Buffalo, NY – Erie County Sheriff Timothy B. Howard reports Deputies made two separate DWI arrests during the overnight patrol shift. 

December 11, 7:29 P.M., Town of Collins – While patrolling Route 438, Deputy Hyde observed a vehicle which crashed into some tree.  The vehicle sustained substantial damage, and the driver side airbag deployed.  The Deputy pushed the airbag aside, but there were no occupants, he then walked around the vehicle and found a female.  The Deputy detected a strong odor of alcohol and signs of impairment and administered standard field sobriety tests and an initial breath test.  Olga Fushchini, 29 of Amherst, failed the tests and registered a BAC level of nearly two and a half times the legal limit.  Fushchini is charged with aggravated DWI and two vehicle and traffic infractions.  She was later released to a sober third party. 

December 11, 11:07 P.M., Town of Concord – Deputy Farina initiated a traffic stop at the interchange of Routes 39 and 219 for a vehicle and traffic law violation.  During the Deputy’s investigation, he detected the odor of alcohol and observed an open can of beer in the vehicle.  Heather Hess, 35 of East Otto, failed standard field sobriety tests and registered a BAC level of one and a half time the legal limit.  During processing at the Springville Substation, the Deputy discovered a quantity of Alprazolam, Hydrocodone, and Tramadol in Hess’ possession.  Hess is charged with DWI, three counts of criminal possession of a controlled substance, a count of possessing a controlled substance not in the original container, drinking alcohol in a motor vehicle on a highway and operating an unregistered vehicle on the highway.  The defendant was released to a sober third part with appearance tickets for Springville Village Court.
