The Operator was Drinking in the Vehicle, had a BAC Nearly 3x the Limit

 

Buffalo, NY – Erie County Sheriff Timothy B. Howard reports a DWI arrest following an investigation into a one-vehicle crash on Lapp Road in the Town of Clarence.

 

At approximately 3:15 A.M. on March 6, a passerby called Sheriff’s dispatch about a single vehicle crash where the vehicle struck a tree, and the driver was unresponsive.  Deputies Mulhern and Klemp responded to the scene, and members of a fire company were extricating the driver.

 

Deputies interviewed Brendan Fogarty, 25, of Hamburg and determined he was impaired.  An initial breath screening indicated the individual was nearly three times the legal limit of .08%.

 

Fogarty was transported to Erie County Medical Center for non-life-threatening, upper body injuries.

 

Fogarty was arrested and charged with DWI and several vehicle and traffic infractions including drinking alcohol in a vehicle, speeding, and a seat belt violation.
