Homeowner Tried to Hide from Deputies in the Dwelling

Buffalo, NY – Erie County Sheriff Timothy B. Howard reports Deputies responded to reports of female passed out and an underage drinking party at a Coyote Court residence in the Town of Clarence.

On June 24, at 9:37 P.M., Deputy Arney arrived and entered the dwelling then proceeded to the basement where he found approximately twenty juveniles, open beer cans and alcohol bottles. The Deputy also met with some the parents of the juveniles at the residence, and they detailed how they made multiple attempts to contact the homeowner throughout the night without success.

Deputy Klemp and Sergeant Lehning arrived to assist with the incident, and Sergeant Lehning found the homeowner, Tracy Cicero, 51, of Clarence hiding in the dwelling.  Cicero is charged with 2nd degree criminal nuisance – creating conditions which endanger others, a Class-B misdemeanor.

The juveniles were released to the custody of their parents, and Cicero was released after being processed and faces a future court date.
