Road Patrol Deputies Make 4 Separate Traffic Stops 

Buffalo, NY – Erie County Sheriff Timothy B. Howard reports multiple traffic stops resulting in DWI charges. 

July 7, 10:04 A.M., Town of Clarence – Deputy Szczepanski located a vehicle that was reportedly driving on the wrong side of the road and initiated a traffic stop on Main Street.  When speaking with the operator, the Deputy observed signs of impairment and administered standard field sobriety tests.  John Madsen, 30 of Williamsville, failed multiple field tests and was evaluated by Drug Recognition Expert Deputy Biegasiewicz.  Following the evaluation, Madsen was arrested and charged with DWI-Drugs and a vehicle and traffic violation, then transported to the Erie County Holding Center.  The defendant posted a $250.00 bail and was released. 

July 7, 10:06 P.M., Village of Springville – Patrol Deputies were responding to the Village of Springville for an erratic driver complaint, when information was received the vehicle turned in a South Cascade parking lot and struck a light pole multiple times.  When Deputy Reed arrived, he observed Walter Smith, Jr., 60 of Hamburg, standing near the reported vehicle. 

Smith admitted to Deputies he had been operating the vehicle and standard field sobriety tests were administered, then, following the field tests a Drug Recognition Expert was dispatched for additional evaluation.  Deputy Biegasiewicz concluded Smith was impaired by drugs, and he was arrested and charged with DWI-Drugs and criminal possession of a controlled substance.  Additionally, he was charged with possessing a controlled substance in a non-original container and two vehicle and traffic violations.  

Smith was taken to the Erie County Holding Center where he was later released.

July 8, 11:30 P.M., Town of Clarence – Deputy Lundberg stopped a vehicle on Main Street after he observed vehicle and traffic violations.  The driver was given and failed multiple standard field sobriety tests, and registered a BAC level about one and a half times the legal limit.  Jacob Barone, 27 of Akron, was arrested and charged with DWI, drinking alcohol in a vehicle on a highway, and a vehicle and traffic violation.  The defendant was released to a sober third party with tickets. 

July 9, 2:28 A.M., Town of Marilla – A vehicle operated by Kevin Hey, 25 of Gates, NY, was stopped by Deputy Lundberg for vehicle and traffic violations.  Tests indicated the driver was impaired, and he registered a BAC level more than twice the legal limit.  Hey was arrested and charged with aggravated DWI, drinking alcohol in a vehicle on a highway, and two vehicle and traffic violations.  Additionally, Hey’s passenger, John Baker – 26 of Marilla,  was arrested for marijuana possession. 

Both defendants were released on appearance tickets for a future court date.
