Deputies Working with DOT Arrest Driver during Truck Inspection

Buffalo, NY – Erie County Sheriff Timothy B. Howard reports Sergeant Kaderli and Deputy Biegasiewicz arrested a North Tonawanda driver yesterday during a DOT commercial truck inspection.

Just before 11:00 A.M. on March 1, Richard Phillips, 48, was brought to the Eastern Hills Mall parking lot for a DOT truck inspection.  During the inspection, Deputies suspected the driver was impaired and administered standard field sobriety tests.  After failing the tests, the driver was taken to the Clarence Substation for processing and a breath test indicated Phillips’ BAC level was nine times the legal limit for commercial vehicle drivers.

Phillips is charged with DWI and consumption of alcohol in a vehicle and was released to a third party.
