Driver in Fatal Sardinia Crash Arrested On Vehicular Manslaughter Charges

Buffalo, NY – Erie County Sheriff Timothy B. Howard reports his office has completed its investigation into a fatal crash on Route 16 in the Town of Sardinia and has arrested the driver of the vehicle – Kevin McCabe, 32 of Belfast, New York.

This investigation was initiated after the defendant’s southbound vehicle on Route 16 crashed into the back of a turning tractor trailer on October 8; the crash killed the defendant’s 4-year-old son and injured a second passenger, an 8-year-old female.

The Sheriff’s Office Crash Investigation Unit worked on this case for multiple weeks interviewing witnesses, examining video footage from residences and businesses along Route 16 and analyzed information gathered at the crash scene.  The Crash Investigation Unit’s work and the discovered evidence lead to the arrest of the operator.

McCabe was taken into custody Tuesday afternoon at the Sheriff’s Elma Substation and was charged with vehicular manslaughter in the first degree – a C felony.  McCabe will be was arraigned this in Sardinia Town Court Tuesday evening.

The Sheriff’s Office worked with Acting District Attorney Michael Flaherty’s office to determine the charges.

Charges were not filed against the driver of the tractor trailer.
