Buffalo, NY – Erie County Sheriff Timothy B. Howard reports dispatchers received a call for an accident on Goodrich Road in the Town of Clarence at 1:31 a.m. Tuesday.

Upon Deputy Casey’s arrival at the scene he observed a damaged concrete wall and a vehicle resting in a ditch.  The operator of the crashed vehicle was located in the second vehicle near the scene and while investigating the driver the Deputy detected an odor of alcoholic coming from the subject.

The Deputy administered standard field sobriety tests which the vehicle’s operator failed.  Subsequently, Joshua Smith – 21 of Lockport, was arrested and charged with DWI, a license restriction violation, three lane violations, and refusal to take a breath test.

The defendant was released on tickets and faces a future court appearance in Clarence Town Court.
