Patrol Makes 4 DWI Arrests over Long Weekend

Buffalo, NY – Erie County Sheriff Timothy B. Howard reports deputies made four DWI arrest over the Martin Luther King, Jr. Holiday weekend.

January 16, 3:30 am; Town of Elma – Deputy Zamorek initiated a traffic stop on Transit Road on a vehicle for speeding and crossing over the center lane.  When the Deputy approached the vehicle, the Deputy detected an odor of alcohol emanating from the driver.  The Deputy attempted to administer standard field sobriety test but the driver was uncooperative, the driver also refused a preliminary breath test and a chemical test at the Elma substation.  Subsequently, Christopher Fox, 36 of Orchard Park, was arrested and charged with a felony DWI, due to a previous conviction, refusal to take a breath test, failure to stay right, and speeding.  Fox was transported to the Erie County Holding Center on $500 bail.

January 17, 12:55 am; Town of Clarence – Deputy Rozycki stopped a vehicle traveling at a high rate of speed on Transit Road.  The Deputy administered standard field sobriety tests and a preliminary breath test; all tests were failed by the operator.   Donald DiPalma, 45 of Williamsville, was charged with DWI and speeding and later released on tickets.

January 17, 3:40 am; Town of West Seneca – Deputy Zamorek initiated a traffic stop on vehicle swerving between lanes on Transit Road.  During the investigation, the Deputy discovered marijuana, a controlled substance which was not in its original container, and an open container of alcohol in the vehicle.  Shari Yerger, 48 of Hamburg, was charged with DWI, possession of marijuana and a controlled substance, and other vehicle and traffic violations.  She was later released to a third party.

January 17, 5:19 am; Town of Boston – Deputy Coniglio was dispatched to Route 219 near Brown Hill Road after a DOT plow driver reported a vehicle off the road.  When the Deputy approached the vehicle, he detected a strong odor of alcohol coming from the vehicle.  The operator was taken to the roadway where the Deputy administered field sobriety tests which the individual failed.  Eric Breindel, 33 of Angola, was charged with a felony count of DWI, due to a prior conviction, speeding, failure to keep right, and unsafe lane change.  The defendant was taken to the Erie County Holding Center pending his arraignment.
