Erie County Sheriff Timothy B. Howard reports the arrest of a Town of Basom man for Driving While Intoxicated.
Deputies Gregory Kent, Robert Lazarczyk and Dennis Orlowski received a complaint that a male subject, identified as 36 yr. old Robert Van Pelt, was observed driving a vehicle onto the 18th fairway of a golf course in the Town of Newstead. Once Mr. Van Pelt stopped, he exited the vehicle and started walking towards Carney Road. Patrol located Mr. Van Pelt and it was determined that he was intoxicated. Mr. Van Pelt was taken into custody and transported to the Erie County Sheriff's Clarence Substation where a chemical breath test was administered. The test revealed that Mr. Van Pelt's blood alcohol content was found to be .28%, more than three times the legal limit. Upon further investigation, it was discovered that Mr. Van Pelt had a prior DWI conviction in April of 2011; therefore Mr. Van Pelt was charged with Felony Aggravated DWI, Trespass, Criminal Mischief and various other vehicle and traffic charges. Mr. Van Pelt was taken to the Erie County Holding Center pending arraignment in the Town of Newstead Court at a future date.
The Erie County Sheriff's Office was assisted by the New York State Police and Akron P.D. This was the 79th DWI arrest by Erie Co. Sheriff's Office in 2014
