Sheriff Timothy B. Howard reports the early morning arrest of a Chaffee man for DWI, Resisting Arrest, Obstruction, and numerous traffic infractions following a traffic stop in the Town of Sardinia.
Erie County Sheriff's Deputy Brad Ballantyne was on patrol on Olean Rd. in the Town of Sardinia, near Chaffee-Curriers Rd. around midnight Thursday when he observed a vehicle swerving into oncoming traffic. Deputy Ballantyne attempted to stop the vehicle, which continued south on Olean Rd. and drove behind a plaza in the area.
Upon interview and an attempt to administer field sobriety tests, the driver, 29 year old Azariah J. Schwartz of Olean Rd. in Chaffee, was found to be intoxicated. He continued to be belligerent and confrontational toward patrol. After several commands to step back, Schwartz continued to be confrontational and hostile, and he was subsequently Tasered and taken into custody.
Schwartz was charged with DWI, Resisting Arrest, Obstruction, Disorderly Conduct, and numerous traffic violations.
Schwartz was taken to Bertrand Chaffee Hospital for evaluation and later released. He refused any further BAC testing.
Schwartz's vehicle was towed from the scene and he was taken to the Erie County Holding Center and held pending arraignment in the Town of Sardinia Court.
This is the 107th DWI arrest by the Erie County Sheriff's Road Patrol this year.
