APRIL 9, 2012 Erie County Sheriff Timothy B. Howard reports two alcohol related traffic arrests by Sheriff’s Road Patrols early Sunday. While on patrol in the area of the Buffalo-Niagara International Airport, Deputies Simon Biegasiewicz and Joseph Cottone stopped a vehicle driven by Mark Fitzgerald of Amherst for a traffic violation. Subsequent to this stop Mr. Fitzgerald was arrested for Driving While Intoxicated and Criminal Possession of Marijuana in the 4th degree.
That charge is the result of the defendant being in possession of more than 2 ounces of marijuana. Upon leaving the laboratory after dropping of the marijuana for their previous arrest the deputies observed a vehicle traveling at a high rate of speed the wrong way on Elm Street, a one-way road, near the Erie County Public Safety Campus downtown. This led to the arrest of Deshawn Jackson, of Buffalo, for Driving While Intoxicated.
Mr. Jackson was released on an appearance ticket to appear in Buffalo City Court at a future date. Deputy Biegasiewicz has previously been recognized by the New York State Stop-DWI Foundation and Mothers Against Drunk Driving (MADD) for his efforts against drinking and driving.
