June 5, 2013- Erie County Sheriff Timothy B. Howard reports the arrest of two local men for Driving While Intoxicated on Wednesday night in separate incidents by Sheriff’s Road Patrols.
While on patrol in Clarence at approximately 10:20PM, Deputy Simon Biegasiewicz arrested Robert H. Peterson (34) of Cheektowaga and charged him with Aggravated DWI, Unauthorized Racing, multiple traffic infractions and Marihuana Possession after he and Lt. William Cranston stopped his (and another vehicle) for racing southbound on Transit Road from Main Street in Amherst. A breath test revealed his blood alcohol content to be .19%, over twice the legal limit. He (along with the driver of the other racing vehicle) were released on appearance tickets.
Later in the night, while on patrol in Akron at approximately 1:50AM, Deputy Biegasiewicz arrested Brandon M. Kuss (31) of Alden and charged him with D Felony DWI and multiple traffic infractions after he stopped his vehicle for driving in the oncoming lane of traffic on John Street. A breath test revealed his blood alcohol content to be .15%, almost twice the legal limit. The D Felony charge was filed due to Kuss having two prior convictions for DWI within the last ten years. He was transported to the Holding Center to await arraignment.
