August 12, 2012- Erie County Sheriff Timothy B. Howard reports the arrest of two people in relation to a fatal accident. On July 21, 2012 at about 11:00 pm, members of the Erie County Sheriff's Office Accident Investigation Unit were called to a fatal accident on Route 20, on the Seneca Nation of Indians. While at the scene it was determined that an east bound motorcycle, operated by Charles H. Phillips age 53 of Derby struck the side of a car that made a turn in front of him. Mr. Phillips was pronounced dead at Lake Shore Hospital that night. The car was occupied by Jessica N. Mann, age 27 of Dunkirk and a 16 year old male acquaintance. At the time of the accident, both Ms. Mann and the 16 year old stated that the 16 year old was driving. Both gave written statements to Sheriff’s Deputies making the claim. Further investigation by the Accident Investigation Unit revealed that Ms. Mann was, in fact, the operator of the car at the time of the accident. The investigators discovered a digital recording from a store near the accident scene and another from over ten miles away that showed Ms. Mann operating the vehicle. Ms. Mann was taken into custody while visiting a friend in the City of Buffalo. She was arraigned in the Town of Brant Court and held on $2,500.00 bail. She has also been detained by federal authorities for an incident that occurred in the City of Dunkirk in February of this year. The 16 year old male was questioned, processed and released pending an appearance in the Town of Brant Court, later this month. Both face charges of Giving a False Written Statement, Obstructing Governmental Administration and Conspiracy. Ms. Mann was also ticketed for Failure to Yield the Right of Way and Unlicensed Operation.
