Erie County District Attorney Frank A. Sedita, III announced that 31 year old David Masse of 149 Midshore Drive, Hamburg, pleaded guilty as charged to Criminal Mischief in the Third Degree before Erie County Court Judge Thomas P. Franczyk.  This is the highest charge for which Masse could have been convicted had he gone to trial. 

Masse is a level two sex offender, having been previously convicted of Attempted Sexual Abuse in the 3rd Degree for sexually abusing a person incapable of consent by reason of being physically helpless. On April 1, 2013, while the homeowner/victim was inside, Masse caused substantial damage to a residence, purportedly because Masse believed his neighbor was a “robot.” Not surprisingly, efforts have been made by the neighborhood association to prevent Masse from residing there again. 

The case was successfully prosecuted by Assistant District Attorney Ashley M. Morgan.  Masse faces a maximum prison term of 2 - 4 years as a second felony offender when he is sentenced before the Honorable Thomas P. Franczyk on August 28, 2013 at 9:30 a.m.
